Ditch Witch, Vermeer Settle Lawsuit over HammerHead Products
Earth Tool Co. (ETC) has announced that a settlement has been reached between itself, the Charles Machine Works, Inc. (CMW) and Vermeer Corp. regarding litigation related to the purchase of ETC by CMW.
The Charles Machine Works Inc., manufacturer of Ditch Witch underground construction equipment, announced in the spring that it has acquired 100 percent ownership of HammerHead Trenchless Equipment, manufactured by Earth Tool Co. LLC (ETC), which had a close relationship with Vermeer. The acquisition makes ETC a wholly owned subsidiary of CMW.
ETC, whose products are marketed under the brand HammerHead Trenchless Equipment, is a worldwide leader in the design and manufacture of innovative underground construction equipment including a complete line of HammerHead moles, HammerHead bursting products, HammerHead ramming tools, and HammerHead HDD tooling including TriHawk, Hawkeye, and SplineLok.
Based on the terms of the settlement, HammerHead Moles, HDD tooling and parts are now available through authorized Ditch Witch dealers worldwide. In addition, HammerHead Moles will be available non-exclusively through Vermeer dealers for a period of two years, HammerHead HDD tooling will be available non-exclusively for three years and parts will be available through Vermeer dealers for 15 years.
